Proficient Travel, Inc. is acting as a mere agent for SUPPLIERS (identified on the final travel documents) in selling travel-related accepting services, or in accepting reservations or bookings for services that are not directly supplied by this Travel Agency (such as air and ground transportation, hotel accommodations, meals, tours, cruises, etc.). Travel Agency, therefore, shall not be responsible for breach of contract,failure to comply with any laws such as the Americans with Disabilities Act (ADA), or any intentional or negligent actions or omissions on the part of such suppliers, which result in any loss, damage, delay, inconvenience or injury, or death to travelers or travelers' companions or group members.It is the traveler’s responsibility to protect their purchases and Travel Insurance is strongly recommended. Traveler is advised to obtain appropriate insurance coverage against these risks; information is available through this Travel Agency regarding travel insurance. Traveler's retention of tickets, reservations, or bookings after issuance shall constitute consent to the above and an agreement on his/her part to convey the contents hereto to his/her travel companions or group members. By embarking upon his/her travel, the traveler voluntarily assumes all risks involved in such travel, whether expected or unexpected. Traveler is hereby warned of the above risks as well as possible travel industry bankruptcies and medical and climatic disruptions, and the possibility traveler may be unable to travel as scheduled because of personal emergency. I acknowledge that I have been made aware of the benefits of travel insurance. I Do hereby expressly agree to forever release, discharge and hold Proficient Travel, Inc. and its agents, employees, officers, directors,associates, suppliers, affiliated companies, and subcontractors harmless against any and all liability, actions, causes of action, debts, suits,claims, and demands of any and every kind and nature whatsoever which I now have or which may hereafter arise out of or in connection with my trip or participation in any activities arranged for me by Proficient Travel, Inc. and its agents, employees, associates, suppliers, affiliated companies, or subcontractors. The terms of this agreement shall server as a complete release and express assumption of risk for myself, my heirs, assignee, administrators, executors, and all members of my family, including any minors accompanying me. I have read and fully understand the provisions of this release and agree to all of its conditions. I fully understand that this is a legally binding and enforceable agreement and sign it of my own free will. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect. All travel services arranged by Proficient Travel, Inc pursuant to this Agreement will at all times be conditioned upon the availability thereof and will be provided subject to any and all applicable laws, regulations, tariffs, and the terms and conditions of any agreement with a supplier. “Client” agrees that neither Proficient Travel, Inc. nor its parent, affiliates, subsidiaries or representatives will be or become liable or responsible in any way for any loss, costs, expense, injury, accident or damage to person or property resulting directly or indirectly from: (1) the acts or omissions of the suppliers, including, but not limited to: delays or cancellation of services, cessation of operations, breakdown in machinery or equipment, technology problems, changes in fares, itineraries or schedules; (2) acts of or against government or other authorities, including, but not limited to: wars, acts of terrorism, piracy, civil unrest, strikes, riots; (3) thefts, pilferage; (4) epidemics, quarantines, other disease; (5) climatic aberrations, acts of God, fire; or (6) dangers incident to activities and/or from any other cause beyond Proficient Travel, Inc.’ control. Client hereby agrees to hold the Proficient Travel Inc entities harmless from and against any and all claims, liabilities, and costs of any kind. Force Majeure – PROFICIENT TRAVEL INC shall not be responsible for failure to perform any of its obligations under this Agreement during any period in which such performance is prevented or delayed due to Force Majeure, nor for changes to or terminations of your trip due to Force Majeure. We regret we will be unable to make any refunds (unless we obtain any refunds from our Suppliers). “Force Majeure” refers to any event beyond PROFICIENT TRAVEL INC reasonable control, including but not limited to severe weather, fire, flood, mudslides, earthquakes, war, labor disputes, strikes, epidemics, disease, virus, pandemic, contagious diseases, World Health Organization’s advisories and/or alerts, Center for Disease Control’s advisories and/or alerts, U.S. State Department’s advisories and/or alerts, any order of any local, provincial or federal government authority, interruption of power Services, terrorism or any other causes beyond the control of PROFICIENT TRAVEL INC. Further instances of which PROFICIENT TRAVEL INC is not liable: Government law, regulation or order (including governmental advisories, quarantines, hotel closures, airport closures, border closures, and curfews) or travel advisory, or action by any governmental authority; an act, event or occurrence creating a significant risk to the anticipated attendees’ health or safety; epidemics, pandemics, or any other threat or fear of any infectious or communicable disease in humans, including (without limitation) the current or any future outbreak of the novel coronavirus (COVID 19), whether actual or perceived, without requiring the issuance of any travel advisory or warning, or the imposition of quarantine or restriction in movement of people by any government authority or national or international body or agency of any government in connection with, or related to any infectious or communicable disease in humans; or postponement or cancellation of the trip. PROFICIENT TRAVEL INC reserves the right to cancel any services described in a Trip Itinerary due to Force Majeure. Very rarely, you may be forced by "force majeure" to change or terminate your Trip after departure but before the scheduled end of your Trip. This is unlikely but if this situation does occur, we regret we will be unable to make any refunds (unless we obtain any refunds from our Suppliers), pay you any compensation, or meet any costs or expenses you incur as a result. We strongly recommend that you obtain travel insurance.
