In order to partake of the enjoyment and excitement of this trip I am willing to accept the risks and uncertainty involved as being an integral part of my adventure. I understand the physical requirements of the activity in which I will be participating, and I currently have no known physical, medical or mental condition which would impair my ability to participate in this tour or my safety in this activity, and I am willing to assume all risks that may be created, directly or indirectly, by any such condition. I hereby authorize Travel by Beth, LLC or my local ground handler or others to arrange for any emergency medical treatment and hospitalization as may be necessary for me because of participation in this activity without my further consent. I hereby accept and assume full responsibility for any and all risks of illness, injury or death and of the negligence of Travel by Beth and agree to hold harmless and release Travel by Beth, LLC from claims of third-party negligence. Agency has no special knowledge regarding entry requirements, unsafe conditions, health hazards, weather hazards, supplier bankruptcies or the suitability for disabled persons for any portion of the trip. CREDIT CARD PAYMENT TERMS: o All credit cards must have verifiable US or Canadian billing address. o If you are making a purchase for another individual, and are not personally on the itinerary, please confirm the passenger’s name on the Payment Form or email us. Please note that Travel by Beth, LLC is not liable for incorrect information submitted by the client or their representative and any fees incurred are the responsibility of the individual. o If there is any issue with the credit card, we will notify you within 24 hours; submitting the credit card does not automatically guarantee ticketing. o Travel by Beth, LLC bears no responsibility in the event your credit card is not charged by the tour supplier. There can be a number of reasons for which credit card may not have been charged such as: Airline did not confirm the booking, fare increased since payment information was submitted, insufficient funds available in the credit card, etc. o Travel by Beth, LLC uses stringent safety measures for credit card payment processing. Fraudulent transactions if any, are reported to airport security, airlines and other federal and state organizations. o You agree to be liable for any and all credit card payments disputes or other problems such as fraud made to us or the supplier on behalf of you or any individual you are representing. You agree to reimburse Travel by Beth, LLC in cases of fraud or charge backs. o All credit card transactions must be submitted in writing and no payments can be made by phone. o Online credit card transactions are authorized at the time a user or anyone acting on their behalf accepts these terms and conditions and provides an electronic signature. CREDIT/DEBIT CARD DECLINES: At the time of processing your transaction if your credit card declines, we will make all efforts to notify you by telephone or by way of an email message within 1 business day. The transaction will not be processed if your credit card has declined. The FARE and any other booking details are NOT GUARANTEED. FINAL PAYMENT: Final payments are not automatically charged. Please note your calendar of this final payment date as reminders may not be sent, however we try to send reminders approximately 10 days before it is due. You can go to https://travelbybeth.com/forms/ on the date you'd like the payment to be posted and use the credit card form. Travel by Beth, LLC is not responsible for cancellations due to payments made after this date. Late fees will apply. LATE FEES: Final payments not received prior to the due date above will incur a $25 per person late fee. All reservations are subject to cancellation and hotel penalties as described below if final payment is not received on the due date. Late fees are not covered by the travel insurance and are always non-refundable. CREDIT CARD FRAUD AND CHARGEBACKS: You agree to be liable for any and all credit card payments disputes or other problems such as fraud made to us or the supplier on behalf of you or any individual you are representing. You agree to reimburse Travel by Beth, LLC in cases of fraud or charge backs. I have been advised to use a form of payment other than cash or check that may offer me the opportunity to dispute the charge should a vendor cease operating. I acknowledge that filing a "charge back" because I do not agree with cancellation terms and conditions, have changed my mind about travel or other reasons could be considered fraud. Travel by Beth, LLC will dispute charges deemed to be fraud and if necessary, will seek legal remedy on behalf of the suppliers, airlines and tour operators associated with your reservation. CANCELLATION PENALTIES: Pertaining to the land portion of your trip; once your reservation is made a $150 non-refundable penalty will be assessed up until any additional resort penalties take effect. The aforementioned is per person or entire room canceling (so if 1 person within the room cancels these same rules apply for that person). Regarding Airline tickets: if Travel by Beth, LLC booked your tickets, they are 100% non- refundable and subject to individual airline penalties/fees (see insurance below). Any monies paid on reservations that have declined travel protection are non-refundable. All the above would be protected with the optional Travel Insurance with the exception of late fees. If you do not have insurance – natural disasters (such as hurricanes), cancellations for ANY reason (medical/personal emergencies, cancellation of the wedding, etc.) do not relieve you from these penalties. ONLY the Travel Insurance will ensure you coverage. All cancellations must be received in writing. CANCEL FOR COVERED REASONS TRAVEL INSURANCE: Cancel for Covered Reasons Insurance can typically be purchased up until the final payment date for the vacation package. A Covered Reason Policy will cover costs if you cancel for reasons that are specifically stated in the policy. Examples: sickness or injury that prevents you from traveling or a death in the family. These are just examples and you must consult your actual policy that you purchased in order to get a complete and accurate list of Covered Reasons. All travelers on the reservation must purchase insurance if at least one person on the reservation chooses to purchase insurance. Insurance does NOT cover items you purchase outside Travel by Beth, LLC (i.e. airfare, tours, excursions etc). Please Note: if you initially reserve a room only package & add airfare to the package through Travel by Beth, LLC at a later date your cancel for any reason insurance policy cost will be adjusted to accommodate the revised total trip package cost at that time. This plan does not include increased rates associated with a change in the number of individuals occupying a room. If the number of individuals occupying a room changes, the remaining travelers will be responsible for any additional costs incurred as a result of the change in the per-person occupancy rate. CHANGES TO RESERVATIONS: ANY changes made to your existing room reservation are subject to the current rates, promotions, and terms at the time of change. In the event that such a situation occurs; Travel by Beth, LLC will do it’s very best to assist you with finding best possible alternate option(s). If the flight time change is minor (2 hours or less) the airline will automatically make the change (airline policies/rules entitle them to legally do so). Travel by Beth, LLC will notify you of major changes. Please Note: there may be additional costs to re-book a new flight should the airline cancel or make a major change to your original flight itinerary. Travel by Beth, LLC is NOT responsible for any additional costs or fees imposed by the airlines. It is the responsibility of the passenger to check for last minute airline flight time changes within 24 hours of departure. Travel by Beth, LLC is not responsible for changes that may occur within 24 hours of original flight departure time. RE-CONFIRM YOUR FLIGHTS: Travel by Beth, LLC advises you personally re-confirm your flight schedule within 24 hours prior to departure directly with the airline in case of any last minute changes or delays. Most airlines allow you to check in online 24 hours prior to departure using the “Record Locator” (found in your Travel by Beth, LLC documents). Travel by Beth, LLC does not assume any liability whatsoever for canceled flights, flights that are missed by passenger for any reason, or flights not connecting due to delays or any scheduled changes made by the airlines. AIRLINE CHECK IN: Please check in with your airline at the airport no later than two (2) hours prior to scheduled flight departure time. Travel by Beth is not responsible for any additional fees associated with not checking in prior to arriving at the airport. Travel by Beth is not responsible for missed flights for any reason. CORONAVIRUS COVID-19 RELEASE, ASSUMPTION OF RISK, WAIVER of LIABILITY & INDEMNITY AGREEMENT The 2019 Novel Coronavirus* (COVID-19, “Coronavirus”) is a known and rapidly evolving pandemic that is affecting travel worldwide, with continued spread and impacts expected. Client is fully aware of the current global Coronavirus COVID-19 virus outbreak, the current travel restrictions, and inherent risks involved if choosing to travel. Client understands that it is his/her responsibility to check the latest travel information regarding this virus outbreak with the CDC. https://wwwnc.cdc.gov/travel/notices Client understands that it is his/her responsibility to have travel insurance to ensure they have coverage for all medical needs and trip cancellation, but understands that concerns or fear of travel is not a covered reason for cancellation relating to the Coronavirus/ Covid-19 and will be denied. Client holds Travel by Beth, LLC harmless for his election to not purchase travel insurance or any denial of claim by travel insurer as it relates to Covid-19 or any other claim under the policy. Travel insurance generally only covers unforeseen events. Most insurers classified COVID-19 as a 'known event' late January 2020. Please note that most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place. Client understands that he/she is bound by the terms of the insurance policy as it relates to Coronavirus/Covid-19. Client is aware the travel warnings, travel restrictions and rules and understands the risks, is accepting of these and knows that Travel by Beth, LLC holds agency harmless for any travel restrictions, death, illness, cancellations by suppliers, hotels, airlines, cruise lines, tour agencies or any other travel provider, financial loss, quarantining rules or measures put in place at airports or destinations you are traveling through. Client further agrees to hold Travel by Beth, LLC harmless for any financial penalties or fees imposed by the by suppliers, hotels, airlines, cruise lines, tour agencies or any other travel provider due to cancellations or postponements due to COVID-19 and agrees not to institute a credit card dispute or “charge back” to Travel by Beth, LLC for said penalties or fees. Client is aware that additional screening procedures and restrictions may take place at airports and in public areas. Client is aware that these restrictions may include mandatory face coverings and/or temperature checks in airports, hotels, cruise ships, trains, or other means of transport. Client is aware that Immigration restrictions may be put in place before or during your travels that may impede your ability to enter or exit your destination as planned.
